-Marriage Act and the common adoption by DHS.?

I live in Oklahoma and have been in a relationship for nearly seven years, living as husband and wife. My husband has a sister who has signed for custody of his daughter with the state. We're doing … or what he thought. After nearly a year fighting and waiting, filling out paperwork and wait, and I think both would be on the adoption papers, we realized that his name is the name in the adoption papers because they are not "legally" married. We can not get married because he is on disability and lose your insurance if you do. I do not have their own children, a daughter. I despirately want a child but can not have. I'm fine with it, but I am completely devastated by the fact that I will not be his "mom" legally. Yes, I am his mother, but I want this piece of paper. I need this piece of paper. Anyone who has experienced this or something like that before? Advice?

If Social Security disability (SSDI) and nothing else (like SSI) should not be a reason why the two can not marry. Disability insurance by the government is based on work history – it has nothing to do with the fact that you're married or anything other than the number of work credits is based on how many years you have paid into the system. Where is the ISS (which is a financial assurance as required), so if you are married, your income is counted together and were more likely to stop SSI payments. http://eldercare.uniontrib.com/askpros/prosocial115.cfm
